- Farm Bureau opposes any bill that deletes the term “navigable” and redefines “waters of the United States” to include “ALL” interstate and intrastate waters will significantly expand federal regulation and oversight of agricultural activities on private land.
- Since the CWA’s enactment, the EPA has never required a National Pollutant Discharge Elimination System (NPDES) permit for the application of FIFRA-registered pesticides to or over the waters of the United States. Yet, in 2009, the Sixth Circuit Court of Appeals overturned an EPA regulation and ruled that EPA did not have the authority under the CWA to exempt lawfully applied crop management tools from NPDES permitting requirements. Farm Bureau is appealing this decision.
